Please review the terms that govern the use of our website and services.

Please read these Terms of Use ("Terms"), a legal agreement between Montage Art Pvt. Ltd (Arte'Venue) and you ("User"). These Terms govern access to and use of the Arte'Venue website and application, collectively referred to as the "Platform".


1. Using the Services / Signing Up as a User

  1. Users may browse, view, and use some services without signing up. To access features like store credit, personal coupons, gift e-cards and referral rewards, an account is required.
  2. Accounts can be created using personal details or social login (Facebook, Google). By creating an account you agree to Arte'Venue Terms and Privacy Policy.
  3. By using the Platform, you represent that:
    • You are of legal age and competent to contract under applicable laws.
    • If signing up on behalf of an entity, you have authority to bind that entity.
    • Information provided is accurate, authentic, complete, and kept up to date.
    • Billing information provided is correct and verified.
  4. You shall not create an account for another person without permission, impersonate others, use unauthorized names, or use offensive or unlawful user names.
  5. Arte'Venue may suspend or terminate accounts for inaccurate, incomplete, or outdated information.
  6. You are responsible for safeguarding your password and personal/financial details and for all activity under your account.
  7. You shall not use the Platform in violation of any applicable laws or code of conduct.
  8. Arte'Venue does not charge users for browsing or registering, but reserves the right to introduce tariffs for services.

2. Services Offered on the Platform

  • Signing up and managing an account.
  • Browsing and filtering artworks by categories, sizes, colors, and artists.
  • Manufacturing artworks using art prints on paper or canvas, with frames, mounts and stretched canvas options.
  • Buying original handmade art, with framing options.
  • Custom photo framing by uploading your own images.
  • Art Advisory services to help you choose the right artwork for your space.
  • Purchasing artworks via cart and checkout with shipping, billing, and payment options.
  • Image accuracy with minor acceptable size and shade variations.
  • Saving your favorite artworks in "My ArtBoard" for later purchase and organizing artworks.
  • Gift cards and referral rewards when available.
  • Business sales and volume discounts for B2B customers.

3. Manner of Use

  • You will not delete or modify any content, legal notices, or proprietary notices on the Platform.
  • You will not decompile, reverse engineer, or disassemble the Platform or remove any proprietary notices.
  • You will not use the Platform in any unlawful manner or in a way that harms Arte'Venue or any other person.
  • You will not engage in antisocial, disrupting, or destructive acts (spamming, phishing, etc.).
  • You will not upload or share harmful, illegal, infringing, or deceptive content.

4. Grant of Rights

  • Arte'Venue owns all rights to the Platform, software, and content.
  • Arte'Venue Content is protected by copyright; purchasing does not confer IP rights.
  • Users receive a limited, non-transferable right to access and use the Platform for personal use.
  • User Content includes any materials you upload to the Platform.
  • User Content must not infringe third-party rights, contain unsolicited commercial material, or violate law.
  • By uploading content, you grant Arte'Venue rights to use it for Platform purposes and internal analysis.

5. Refund, Exchange, Replacement and Return Policy

Returns

Arte'Venue guarantees customer satisfaction. Returns of artworks (art prints based) are accepted for 100% refund when payment for order is made online in full.

Please note: Returns apply only to art print items. Custom Photo frame items (where customer uploads his/her own picture and we print, frame as per order) and framed original artworks are not eligible for returns. Unframed original artworks can be returned.

The Cash on Delivery (CoD), Partial CoD and orders with payment on No-Cost EMI offer are not eligible for returns.

Process:

  1. Within 5 days of delivery, customer can raise a request for return.
  2. Raise a return request on our website (Menu -> My Orders). If an order is eligible for return,the option to raise the request will be available in the order details.
  3. Customer should retain the artwork in exact same condition as it was received.
  4. Customer will have to ship the artwork to our return shipping address at their cost.
  5. The responsibility of proper packing and ensuring the products reach Arte'Venue in perfectly good, new condition lies with the customer.
  6. Upon receipt of returned artwork by Arte'Venue, it will be assessed for damages. The artwork will not be eligible for refund in case it was recevied with damages or scratches. Arte'Venue can share photos/video of opening the product packing as proof.
  7. Should customer wish to receive their damaged product(s), Arte'Venue will ship it back without any more liability and shipping cost will be borne by the customer.
  8. Arte'Venue will approve the refund when the artwork is found to be in exact same condition as it was delivered to customer.
  9. Along with the approval, Arte'Venue will process the refund in the same online payment mode that was used for the order OR will ask customer for bank details for refund transfer. Arte'Venue cannot make refund in any other mode.
  10. For CoD, Partial CoD, and No-Cost EMI orders are not eligible for refund. In case of damaged delivery, quality issues, or wrong products, Arte'Venue will replace the product at our cost.
  11. The process may take from 2-3 weeks for completion.
  12. We can take the return request only once per order.

Exchange

The Cash on Delivery (CoD), Partial CoD and orders with payment on No-Cost EMI offer are not eligible for exchange.

Process:

  1. Within 5 days of delivery, customer can raise a request for exchange.
  2. Raise an exchange request on our website (Menu -> My Orders). If an order is eligible for exchange,the option to raise the request will be available in the order details.
  3. There is no refund applicable on exchange. If the products chosen costs extra than the ones being replaced, then applicable difference is to be paid the customer.
  4. Customer should retain the artworks in exact same condition as it was received.
  5. Customer will have to ship the artworks to our return shipping address, at their cost.
  6. The responsibility of proper packing and ensuring the products reach Arte'Venue in perfectly good, new condition lies with the customer.
  7. Upon receipt of returned artwork by Arte'Venue, it will be assessed for damages. The artwork will not be eligible for exchange in case it was recevied with damages or scratches. Arte'Venue can share photos/video of opening the product packing as proof.
  8. Should customer wish to receive their damaged product(s), Arte'Venue will ship it back without any more liability and shipping cost will be borne by the customer.
  9. Arte'Venue will approve the exchange when the artwork is found to be in exact same condition as it was delivered to customer.
  10. If there cost of new artworks is more than cost of artworks being replace, then it will be settled by sending payment link to the customer.
  11. Arte'Venue then ships the artworks as per the exchange request to the customer in 3 days after the approval.
  12. CoD, Partial CoD, and No-Cost EMI orders are not eligible for refund. In case of damaged delivery, quality issues, or wrong products, Arte'Venue will replace the product at our cost.
  13. The process may take from 2-3 weeks for completion.
  14. We can take the exchange request only once per order.

Replacement for Damaged Delivery, Wrong Products

In an unlikely event of damages in transit, artwork having quality issue or wrong artwork delivered, it is eligible for free replacement.

Process:

  1. Customer should inform Arte'Venue of damaged delivery, quality issue or wrong artwork delivered within 48 hours from the time of delivery.
  2. As a proof, customer must send photos/videos showing the issue with artwork.
  3. An email can be sent with details and photos to support@ArteVenue.com. It may take longer without quoting the order number in the email.
  4. Arte'Venue shall not be bound to replace the artwork or refund the money if informed after completion of 48 hours from time of delivery.
  5. Arte'Venue will arrange to pick up the artwork from customer delivery address.
  6. If Arte'Venue can't arrange courier pick up from the shipping address, customer will have to ship the artwork to our address.
  7. Customer must retain the artwork in exact same condition as it was received, along with the original packaging.
  8. Irrespective of who ships it, the responsibility of proper packing and ensuring the products reach Arte'Venue in exact same condition as it was delivered lies with the customer.
  9. Upon receipt of returned artwork by Arte'Venue, it will be assessed for further damages. The artwork will not be eligible for replacement in case further damages are found. Arte'Venue can share photos/video of the products.
  10. Arte'Venue will approve the replacement when the artwork is found to be in exact same condition as it was delivered to the customer.
  11. Arte'Venue will ship the replacement artwork in 3 days of approval for replacement.
  12. In case customer seeks refund instead of replacement (applicable only for full online payment), Arte'Venue will ask for bank details or process refund in the same payment mode used for the order. Arte'Venue cannot process refund in any other mode.
  13. CoD, Partial CoD and No-Cost EMI orders are not eligible for refund, only replacement can be prodived.
  14. The process may take 2-3 weeks for completion.

6. Order Cancellation

Orders cannot be cancelled if once placed due to customized production.

8. Disclaimer and Exclusion of Warranties

  • The Platform and services are provided "as is" without warranties of any kind.
  • Arte'Venue is not liable for interruptions, inaccuracies, or delays.
  • Colors and sizes may vary slightly across devices.
  • Arte'Venue disclaims liability for technical issues, data loss, or service downtime.

9. Limitation of Liability

Arte'Venue is not liable for indirect, incidental, or consequential damages. Total liability will not exceed the amount paid by you to access the Platform or services.


10. Indemnification

You agree to indemnify and hold Arte'Venue harmless from claims arising out of your use of the Platform, breach of these Terms, or violation of third-party rights.


11. Third Party Links

The Platform may contain links to third-party websites or resources. Arte'Venue is not responsible for their availability, accuracy, content, or services.


12. Termination / Modification / Suspension

  • Arte'Venue may terminate or suspend access for breach of Terms.
  • You may delete your account to stop using the Platform.
  • Terms may be updated from time to time; continued use implies acceptance.
  • Upon termination, access ends and licenses granted to you terminate.

13. Governing Law and Jurisdiction

This Agreement is governed by the laws of India and the courts at Bengaluru, Karnataka shall have jurisdiction.


14. Arbitration

Disputes shall be resolved through arbitration in Bengaluru, India, under the Arbitration and Conciliation Act 1996, in English. The award is final and binding.


15. Trademark/Copyright Infringement Take Down Procedure

If you believe your work has been infringed, please email support@ArteVenue.com with:

  1. Identification of the copyrighted or trademarked work.
  2. Identification of the infringing material and its location.
  3. A statement of good faith belief that the use is unauthorized.
  4. Your contact information.
  5. Your electronic or physical signature.
  6. A statement under penalty of perjury that the information is accurate.

17. Miscellaneous

  • If any provision is unenforceable, the rest of the Terms remain in effect.
  • Notices will be provided in writing in English.
  • Failure to enforce a provision is not a waiver of rights.
  • Arte'Venue is not liable for force majeure events beyond its control.
  • You may not assign rights under these Terms without written consent.
  • If there is a conflict, the Privacy Policy prevails over these Terms.
